Terms of Use

These Terms govern your use of the getlessrx website and platform operated by Marcon John Solutions Inc. (“getlessrx,” “we,” “us”). Read the linked Privacy Notice and Order, Payment and Refund Policy before using the service. The platform helps you connect with independent licensed prescribers and pharmacies; the Terms explain what getlessrx does, what those professionals do, and how an order request is handled.

1. Platform role and separate providers

getlessrx provides technology, customer support, order coordination and payment administration where offered. getlessrx does not itself practice medicine, prescribe, diagnose, provide clinical advice, compound, dispense or ship medication. A licensed prescriber independently decides whether to evaluate you and whether a prescription is appropriate. A licensed pharmacy independently verifies the prescription, performs its professional review, dispenses, labels and ships an eligible medication. No product selection, questionnaire, payment or order confirmation guarantees a prescription or dispensing.

A provider or pharmacy may require separate terms, informed consent and privacy notices. Those documents govern the professional services they provide; getlessrx’s Terms govern the platform. If a provider declines treatment or a pharmacy cannot fill an order, the applicable payment and refund terms below control.

2. Eligibility and accurate information

You must be at least 18 years old, use the platform for yourself unless a lawful representative workflow is expressly available, reside in a state served by the relevant partners, and provide accurate and current information. Do not submit another person’s ID, prescription or payment details without lawful authority. You must tell the prescriber and pharmacy about your current medications, allergies, relevant conditions and material changes. They may request verification or decline service.

We may suspend access for fraud, misuse, unlawful activity, security risk, or inaccurate information, subject to applicable law and any necessary continuity or records obligations.

3. Account and security

Keep your credentials private and notify us promptly at thecareexperts@medlocker.med of suspected unauthorized use. We may use identity checks and access controls to protect accounts and patients. Your account may display order and transaction information; it is not a complete medical record, prescription history or substitute for a medication reconciliation with a clinician or pharmacist.

4. Requests, clinical review and prescriptions

A product page shows preliminary information and availability. An order request may include an uploaded prescription, a lawful transfer request, or a medical intake for independent prescriber review. A questionnaire is a request for evaluation, not a prescription. A prescription transfer must be completed by authorized pharmacy personnel under applicable law; uploading an image does not by itself establish that a valid, transferable prescription exists.

The prescriber determines the need for examination or other evaluation, may ask follow-up questions, and may decline or refer you for in-person care. The pharmacy independently checks identity, prescription validity, product, availability, state licensing, interactions and other dispensing requirements. The selected product, strength, quantity, brand or price may require clarification or change before dispensing. Any material substitution or added charge must be disclosed and accepted as required by law.

5. Product information and safety

Product descriptions are general information and are not individualized advice or the full FDA-approved labeling. Confirm the exact product, strength, dosage form and instructions with your prescriber and dispensing pharmacist. Seek emergency help through 911 or your local emergency service; do not use this platform for emergencies. Report suspected adverse effects to your clinician or pharmacist.

A compounded medication, if offered lawfully, is prepared by an identified licensed pharmacy for a valid patient-specific prescription. Compounded drugs are not FDA-approved, and no listing should imply equivalence to an FDA-approved product. Additional product-specific information and clinical consent will be provided before an eligible compounded order proceeds.

6. Controlled substances

getlessrx does not offer an ordinary self-service checkout for controlled substances. A product’s status may vary with its precise formulation and state law. Any permitted workflow must satisfy applicable federal and state prescribing, verification, dispensing and delivery requirements and may be unavailable in your state. Display of a product does not promise access to it.

7. Prices and payments

We show the item price, shipping, taxes and any other charge before order placement. Payment methods and processing times vary. A submitted order or payment instruction does not mean funds have settled, a prescription has been issued, or a pharmacy has accepted the order. Any platform service fee included in the price should be disclosed where applicable.

A separate one-time authorization is required for an ACH debit. Do not enter bank credentials unless the payee, amount, timing and processor are clearly identified. For Zelle or other customer-initiated transfers, verify the displayed business recipient and transaction reference; do not send money to a recipient supplied outside the verified checkout. The Order, Payment and Refund Policy controls cancellations, declined requests, failed payment and refunds.

8. Shipping and delivery

The dispensing pharmacy determines whether and how an eligible order can be shipped to the confirmed address, including temperature, identity and signature requirements where applicable. Estimated timing begins only after the necessary clinical, pharmacy and payment steps are complete. We or the pharmacy will provide tracking when available. Contact thecareexperts@medlocker.med promptly about loss, damage, wrong product or delivery concerns.

9. Promotions and marketing

Promotions are subject to separate published terms and applicable federal and state restrictions. A referral code displayed in an account does not establish eligibility, and a benefit may not be applied to an ineligible transaction. Do not submit a transaction for reimbursement contrary to the terms of a lawful, specifically disclosed cash-pay offer. Transactional messages about your request may be sent as permitted by law; promotional email or texts require the applicable separate choice and opt-out mechanism.

10. Privacy and service communications

Our Privacy Notice explains platform data practices. Independent providers and pharmacies may issue their own notices. We may use or disclose information to facilitate the requested service and as permitted by applicable law and our agreements with those entities. We do not treat agreement to these Terms as a blanket HIPAA authorization for marketing or unrelated disclosures. Do not send sensitive information through public social media or unverified channels.

11. Platform availability and changes

We may modify or suspend features, catalog content, pricing or availability. Material changes to these Terms will be posted with a new effective date, and we will obtain renewed acceptance when required. Changes do not retroactively alter an order already accepted unless law or the governing order terms permit. We do not guarantee uninterrupted access, but this does not limit duties imposed by law.

12. Liability and disputes

Nothing in these Terms waives a patient’s rights against a licensed professional, excludes liability that cannot lawfully be excluded, or excuses getlessrx’s own legal obligations. Each party remains responsible for its own acts and duties. To the extent permitted by applicable law, getlessrx’s liability for a platform-only claim is limited to $1,000 in actual damages, except for categories that law prohibits limiting.

13. Governing Law and Venue

These Terms and disputes arising from MJSI’s operation of the getlessrx platform are governed by Delaware law, without regard to conflict-of-laws rules, except where applicable law gives you rights that cannot be waived. Subject to those rights, you and MJSI agree that such disputes may be brought only in the state courts located in New Castle County, Delaware, or the United States District Court for the District of Delaware, and consent to those courts’ jurisdiction. If applicable law does not permit this venue requirement for a particular claim, that claim may be brought in a court permitted by that law. This section does not govern independent prescribers’ clinical services or pharmacies’ dispensing services, which are subject to applicable law and any terms provided by those parties. Nothing in these Terms restricts your right to contact a regulator or exercise rights that cannot legally be waived.
